Department of Health’s Emergency Rule 64ER23-2
Effective June 12, 2023, as outlined in section 381.986(6)(b)6., Florida Statutes, and the Department of Health’s Emergency Rule 64ER23-2, individuals who are not considered close relatives and are applying for a caregiver Medical Marijuana Use Registry (MMUR) identification card are required to undergo a level 2 background screening.
This requirement is in accordance with section 381.986(9), Florida Statutes, and must be completed through a Livescan Service Provider.
According to section 381.986(1)(c), Florida Statutes, a “close relative” is defined as a spouse, parent, sibling, grandparent, child, or grandchild, regardless of whether the relationship is through blood, marriage, or adoption.
How It Impacts New Medical Marijuana Caregivers (Initial Application)

The fingerprints of all medical marijuana caregivers required to undergo the level 2 background screening will be stored in the Applicant Fingerprint Retention and Notification Program (AFRNP). Participation in the AFRNP requires an annual fee of $6.00, which caregivers are responsible for paying. The first year of participation is fee-free. The Office of Medical Marijuana Use (OMMU) will provide caregivers with a notification at least 30 calendar days before the annual retention fee is due.
Please be aware that non-close relative medical marijuana caregiver applications may have a longer review and approval process compared to close relative caregiver applications.
